1. Agreement to Terms

By enrolling in GlowUp Academy training programs, accessing our website, or using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from enrolling in our programs or using our services. These terms constitute a legally binding agreement between you and GlowUp Academy (operated by SuperSystems LLC).

2. Description of Services

GlowUp Academy provides professional beauty and aesthetics training programs, including but not limited to Laser Therapy Training, Permanent Makeup certification, and Lash Extensions courses. Our services include intensive hands-on training, theoretical education, practical assessment, industry-recognized certification, and ongoing support. All training is provided by qualified, certified instructors with extensive industry experience.

3. Enrollment and Registration

To enroll in our training programs, you must:

  • Be at least 18 years old or the age of legal majority in your jurisdiction
  • Provide accurate, current, and complete information during registration
  • Complete all required enrollment forms and health questionnaires
  • Pay all applicable tuition fees and deposits as specified
  • Agree to comply with all academy policies, safety protocols, and code of conduct
  • Provide proof of any required prerequisite qualifications or licenses (where applicable)
  • Acknowledge that certain programs may have physical requirements or health contraindications

4. Student Responsibilities

As a student, you agree to:

  • Attend all scheduled training sessions and arrive punctually
  • Complete all required coursework, assessments, and practical evaluations
  • Follow all safety protocols, sanitation standards, and professional guidelines
  • Treat instructors, fellow students, and training models with respect and professionalism
  • Maintain confidentiality regarding proprietary training materials and techniques
  • Provide accurate health information and disclose any conditions that may affect training participation
  • Use equipment and supplies responsibly and in accordance with instruction
  • Refrain from practicing learned techniques on clients until properly certified
  • Maintain appropriate professional liability insurance when operating independently

5. Payment Terms and Tuition

By enrolling in a training program:

  • You agree to pay all tuition fees, deposits, and associated costs as specified in your enrollment agreement
  • Payment plans, if available, must be set up before the training start date
  • All payments are processed through secure third-party payment processors
  • Late payment fees may apply to overdue installments as specified in your payment plan agreement
  • Course materials, starter kits, and supplies are included in tuition unless otherwise stated
  • You are responsible for any applicable taxes, duties, or fees based on your jurisdiction
  • Prices are subject to change, but enrolled students are locked in at their registration price

6. Refund and Cancellation Policy

Our refund policy is as follows:

  • Before Training Begins: Full refund minus administrative fee (10%) if cancelled at least 14 days before start date
  • 7-13 Days Before: 50% refund of tuition paid
  • Less than 7 Days: No refund available; you may transfer to a future session (transfer fee applies)
  • After Training Begins: No refunds once training has commenced
  • Academy Cancellation: Full refund if we cancel or reschedule your program without a mutually acceptable alternative
  • Medical Exceptions: Considered on a case-by-case basis with appropriate medical documentation
  • All refund requests must be submitted in writing to student services

7. Certification Requirements

To receive your professional certification, you must:

  • Complete all required training hours and attend all sessions
  • Pass all written examinations with a minimum score of 80%
  • Successfully complete all practical assessments
  • Demonstrate proficiency in all core techniques
  • Complete supervised live model work as required by your program
  • Comply with all safety and sanitation protocols
  • Submit all required documentation and portfolio materials

Failure to meet certification requirements may result in a certificate of attendance only, or the need to retake portions of the program (additional fees apply).

8. Health and Safety

Training involves hands-on practice with equipment, chemicals, and procedures that carry inherent risks. You acknowledge that you have been informed of these risks and accept responsibility for your participation. You must disclose any medical conditions, allergies, or physical limitations that may affect your safe participation in training activities. We reserve the right to exclude students from certain activities if participation poses a health or safety risk. All students must comply with sanitation protocols, use personal protective equipment as required, and follow all safety instructions provided by instructors.

9. Intellectual Property and Training Materials

All training materials, manuals, videos, presentations, and proprietary techniques provided during the course are the intellectual property of GlowUp Academy and are protected by copyright and trademark laws. You may use these materials for personal learning and reference only. You may not reproduce, distribute, sell, or share training materials without written permission. Any violations may result in immediate dismissal from the program without refund and potential legal action.

10. Code of Conduct

We maintain high standards of professional conduct. The following behaviors may result in dismissal from the program without refund:

  • Harassment, discrimination, or inappropriate behavior toward instructors, students, or models
  • Attendance under the influence of alcohol or drugs
  • Theft or damage to academy property or others' belongings
  • Violation of health, safety, or sanitation protocols
  • Dishonesty or academic misconduct
  • Unauthorized recording or photographing of training sessions
  • Any illegal activity on academy premises

11. Photography and Portfolio Use

With your consent, we may photograph or video your practical work for your portfolio and our marketing materials. You retain rights to your own work but grant us a non-exclusive license to use such images for promotional purposes. If you prefer not to be photographed or have your work used in marketing, please notify us in writing. Model clients must also provide consent for any photography or portfolio use.

12. Limitation of Liability

To the maximum extent permitted by law, GlowUp Academy and SuperSystems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your enrollment or participation in training programs. Our total liability shall not exceed the amount of tuition you paid for your program. We do not guarantee specific career outcomes, earnings, or employment results. Your success depends on your skill, effort, business acumen, and market conditions beyond our control.

13. Post-Certification Obligations

Upon certification, you are responsible for:

  • Complying with all local, state, and national regulations governing your practice
  • Obtaining any required licenses, permits, or insurance
  • Maintaining professional standards and ethical practices
  • Continuing education to stay current with industry developments
  • Using techniques safely and appropriately on clients

We provide training and certification but do not control your professional practice after graduation. See our separate Indemnity Agreement for details on post-certification liability.

14. Service Availability and Schedule Changes

While we strive to maintain scheduled training dates, we reserve the right to reschedule sessions due to instructor availability, facility issues, or insufficient enrollment. We will provide reasonable notice and work with you to find a suitable alternative. In cases of emergency or force majeure (natural disasters, pandemics, etc.), we may need to postpone or move training online without liability for consequential damages.

15. Termination and Dismissal

We reserve the right to terminate your enrollment and access to training immediately, without prior notice, refund, or liability, if you breach these Terms, violate academy policies, engage in misconduct, or pose a risk to health and safety. You may voluntarily withdraw subject to our cancellation and refund policy. Upon termination or withdrawal, you must return all academy property, materials, and equipment.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated date. Enrolled students will be notified of material changes that affect their current program. Your continued enrollment after such modifications constitutes acceptance of the updated Terms. Terms in effect at the time of your enrollment will generally govern your program.

17. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your enrollment shall first be subject to good faith negotiation. If unresolved, disputes shall be resolved through binding arbitration in Wyoming in accordance with the American Arbitration Association rules, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action.
